TRAI DND Regulation

You may be aware that TRAI has issued The Telecom Commercial Communications Customer Preference Regulations on 27.9.2011 for curbing pesky calls and SMSs. The provisions of these regulations are such that in case a call/SMS is sent to a DND registered customer heavy penalty will be levied on telemarketers. For controlling unregistered telemarketers from sending bulk SMSs, TRAI has also put a cap of 200 SMS per day per SIM.

Do you think TRAI through these regulations is successful in curbing unwanted telemarketing calls?

  4. Yes, its a right initiative and even through this TRAI is successful in curbing commercial calls and empowered consumers against unwanted calls and SMSes.

    But TRAI must re-consider the sms cap, if it is limited, it is irritating to call for everything , Mobile users like text messaging and stats show 95% of all text messages get opened within five minutes, which is faster than email and social media updates.
    I strongly believe TRAI’s intentions for the SMS cap is noble, but issue is against an individual’s right to communicate and to choose the medium to communicate through.
    Why ban at 200 SMS?
    What if someone had to send an emergency SMS and has already spent their 200 SMSes quota?
    Why could not TRAI come up with any another solution?
    Why not limit the discounted SMS rates at 200 per day, and if one wished to send a 201st SMS, allow it to be sent at a normal or even a higher rate. Instead of bounding the customer, why not hold the operator responsible to ensuring that its SMS packs are not misused?

  5. Vinay...all the bulk SMSs packages those used to be there in the market are no more available for unregistered to use....also unregistered TM resources are disconnected on second violation..

  6. Rather than sms cap TRAI could have used word detection/mapping instruments used by intelligence agencies wherein messages with pre defined word gets detected & only the malpracticing people face the ire noy comman man.

  8. It is a great initiative by TRAI. The calls have really been curbed but still a lot has to done for the SMS part.

  9. @maninder- the tampering with content is against the license condition for Access Providers.. As for TRAI if it decides to drop a message with predefined word ...many genuine messages may also get dropped....TRAI is already catching registered Telemarketers....For unregistered ones no. is disconnected on second violation...

Indeed its a good initiative by TRAI, but taking an initiative is just one part, and the ability and/or willingness to carried this initiative in a proper manner with good faith in the interest of consumers in another part. I am following TRAI from say last 4 years when i joined my MBA and from that day i have observed that the implementation part of any regulation has not been carried out quite well. Whether its the QOS regulations or the Tariff Orders. The same thing is happening in case of this regulation too. I have observed that TRAI facing problems in implementing the regulation properly. Thoguh, TRAI has given us a huge relief through this regulation. There are a lot of reasons behind this "half full half empty" attempt towards the implementation. Some of them can be: Failure in the monitoring/auditing of the companies which is due to the fact that TRAI might don't have sufficient staff, taking much more time in the decision making, and the third and biggest reason is that TRAI don't enjoy much power which eventually need to control the service providers for the proper compliance of each and every regulations. Regarding the capping in the no. of SMSs per day per SIM, though we all know that the unregistered TM uses the common numbers for sending messages but the thing is that its depriving the consumers from their fundamental rights. What if one day TRAI said that a consumer can not make calls of more than 200 Mins per day per SIM. So in my views the capping in the no. of SMSs should be taken back by the TRAI and I congratulating TRAI for bringing such a good regulation in the interest of consumers but also they have to implement it in proper way. My own experience with Vodafone was not good regarding the DND registeration. Wishing TRAI and its Team who is working for the implementation of this regulation all the best.
